Georgia residents now have a new option for simplifying their estate plans with the introduction of Transfer on Death Deeds (T.O.D.D.), which became available in July 2024. This legal tool allows homeowners to transfer real estate directly to a designated beneficiary without the need for probate, providing a more efficient way to pass on property.

A Transfer on Death Deed enables the property owner to name a beneficiary who will automatically inherit the property upon the owner’s death. Until that time, the owner retains full control over the property, including selling or mortgaging it.
