A U.S. Federal District Court Judge ruled Friday, February 17, in the case of Sterigenics U.S., LLC v. Cobb County, et al. The ruling dismisses the federal case brought by Sterigenics against Cobb County and its Fire Marshal and Chief Building Inspector. The ruling allows the facility to continue operating, but it maintains Cobb County's ability to enforce regulations.

The County Attorney is still evaluating the Court’s comprehensive order. I recognize the order will allow the facility to continue operating; however, I also note the Court expressly recognized Sterigenics did not present any evidence that our Fire Marshal or Chief Building Official “acted other than in good faith and in keeping with their professional responsibilities.” The order makes it clear that the county will still have the opportunity to monitor the facility and ensure it operates in the interest of public safety.
