State Representative Sharon Cooper (R-Marietta) expressed her satisfaction as Governor Brian Kemp signed House Bill 218 into law, a bill aimed at enhancing safeguards for Georgia's elders and mentally disabled individuals in legal proceedings. The legislation, co-sponsored by Rep. Cooper, provides a precise definition of "mentally incapacitated" and allows out-of-court statements to be used as admissible testimony.

Chair Cooper, who is also the chair of the House Public Health Committee, highlighted the significance of House Bill 218, stating, “This legislation represents a testament to our commitment to justice and protection against elder abuse and for mentally incapacitated individuals."

The bill was developed at the request of the North Georgia Elder Abuse Task Force, reflecting a collaborative effort to address critical issues concerning vulnerable populations. Rep. Cooper emphasized the importance of the legislation in strengthening safeguards within the legal system and empowering individuals to seek justice.

In her remarks, Rep. Cooper acknowledged the collaborative nature of the legislative process, stating, “I was proud to see this legislation be signed into law by Governor Kemp." She also expressed her gratitude for the opportunity to work alongside Rep. Scott Hilton (R-Peachtree Corners) in co-sponsoring the bill.

With the enactment of House Bill 218, Georgia is taking a significant step towards setting national standards for safeguarding vulnerable individuals and combatting abuse. The inclusion of precise definitions and provisions for out-of-court statements is expected to enhance legal protections and support for elders and mentally incapacitated individuals in the state.
